QUESTION:

I have found plenty of internet marketing information, but where can I find basic legal information about an online business? I'm interested in things like business structure, permits, and things like that. Thank you.

ANSWER:

One of the reasons it's harder to find information like the stuff you're looking for is that it can vary widely depending on your personal situation, including where you live. For instance, zoning regulations vary from area to area, as do licensing and permit requirements.

Your best bet is to talk to the appropriate people:

  • Competent legal counsel and/or an accountant can advise you on the best business structure for your personal situation.

  • Local authorities - eg. the city bylaw office, or other city department - will probably be able to advise you about permits, licenses, local regulations, etc... or at least they'll direct you to someone who can.

  • For financial matters, talk to a qualified financial advisor as well as to your bank who can let you know what types of services are available to small business owners.

  • For intellectual property matters (patents, copyrights, and trademarks), consult with a qualified intellectual property agent or lawyer. Basic information about some of this stuff is available at the United States Patent and Trademark Office, or the U.S. Copyright Office.

    If you're Canadian, try Industry Canada.

  • A good basic source of information is the US Small Business Administration website.

    Canadians, visit the Business Start-Up Assistant.

  • Also check local small business associations or your Chamber of Commerce. They often have publications that may be able to point you in the right direction.
